Sentence looms for rape and abduction suspect

A 21-year old Katima Mulilo resident who stands accused of raping and abducting a 13 year old girl at Kazauli village in Caprivi region in 2009, is due to be sentenced by Katima Mulilo  Regional Court this month.

Imasiku Kwala will know his fate when the court judgment and verdict into three charges of abduction, two counts of rape- against him is delivered on June 5.

Kwala, who was aged 19 when he was arrested on February 28, 2010 at Ishubu Village in the Musanga area, for the alleged criminal acts committed against his victim, now aged 16 years, between December 2009 and February 2010.

It is alleged that Kwala abducted his victim out of the control and against the will of her mother (names withheld to protect the identity of the child), on December 25, for the purpose of having sexual intercourse and with the intention to marry her.

According to court statements, Kwala then violated the victim by forcefully penetrating his penis into her vagina  on February 26,and was thus in contravention of section 14 (a) (1) that reads with sections 1, 12 and 14 (2) of act 21 of 1980 as amended by act 7 of 2000.

Alternatives to count 2 are that Kwala is guilty of contravening section that reads against committing a sexual act with a child under the age of sixteen (16) years, while on Count 3  he made himself is guilty for contravening the sections and acts for committing a sexual act with a child under the age of 16 years.

Kwala, who is free on bail, is conducting his own defence on CR no is 147/02/2010 while Jatiel Mudamburi is prosecuting for the state.
