Police Officer charged 18 Years for murder

A 47- year – old member of the Namibian Police (NAMPOL) Mr. Albius Mwinda Mabengano was sentenced to 18 years imprisonment for killing a man.

The Katima Mulilo Regional Court sentenced the accused in during the final trial that set on August 10, 2011 for unlawfully and intentionally killing Mr. Reagan Museke Museke, a 28 year old Namibian male by shooting him with a rifle on 14 March 2009 at Mafuta Compound some 5 kilometers away the town of Katima Mulilo.

The regional court magistrate Mr. William Kasitomo and the state prosecutor Mr. Jatiel Mudamburi ruled out the case and the accused person pleaded not guilty to the charge.

The accused argued that he did so because he was defending himself and the evidence in court proved that the accused had an altercation with the deceased and his friends during the afternoon of that fateful day.

Mr. Mabengano testified that the deceased and his friends attacked him with the sticks and Axes which he managed to take away from them and went with them to the police camp at Mafuta.

According to a police officer who witnessed the incidence told the court that when the accused brought some sticks and Axes to the police camp took an AK-47 rifle and cocked it saying he was going to kill someone.

He tried to stop him but the accused did not even listen, he proceeded to hunt for the deceased whom he found drinking beer with his friends at a certain cooker shop and when he was 10 -15 meters from the deceased he raised his gun and fired one short which hit the deceased in the neck and died instantly, Mabengano walked away with his gun after shooting the deceased.

In the ruling of the court it concluded that under circumstances accused Mabengano was not acting in self defence and at the time of firing the short he was not attacked by anybody, the court convicted him of murder with direct intention that he unlawfully and intentionally killed the deceased and he was sentenced to 18 years imprisonment.

In giving its reason for the sentence, the court indicated that it was a very serious offence in which the deceased was brutal killed for no reason.
The accused was represented by Mr. Van Vuuren of Kruger Van Vuuren and partners in Windhoek and the state prosecution was represented by Mr. Jatiel Mudamburi.

Mr. Mabengano have been in police cells since his arrest on 14 March 2009, the regional court case no is 33 of 2010 and the Katima Mulilo CR is 110/03/09, he was a police officer who was stationed at Mafuta police base.
