A Namibian man was sentenced to 13 years imprisonment for raping and assaulting the complainant.
The Regional court magistrate Mr.William Kasitomo sentenced Mr. Herbert Mate Nshimwe who was arrested on April 12, 2012 from Kasheshe Area in the District of Katima Mulilo was found guilty of contravening section 2(1) read section 1, 2(2), 3,5,6 & 7 of the combating of the rape Act, Act 8 of 2000.
The court ruled out that the accused be sentenced to 12 years imprisonment for rape plus 1 year imprisonment for assaulting with the intent to do grievous bodily harm to the complainant.
It was proven that the accused in that day 10th of April 2012 near Kasheshe in the District of Katima Mulilo ,the accused called the victim and did wrongfully and intentionally under coercive a sexual act with Jennicky Namucana Siukuta the complainant by inserting his manhood into her private part while applying physical force against the complainant threatening by pressing her throat and biting her lips with the intention to do grievous bodily harm to the complainant.
Mr. Jatiel Mudamburi represented the state as public prosecutor in the Case RC 09/2013 and CR Number 51-04-2013.
